Terms of Sale

These Terms of Sale govern every order placed on the Neovia online store by a consumer residing in the European Union or in Canada. By placing an order you accept these terms in full, in the version in force on the day of your order.

2. Scope

Neovia sells sports and shaping apparel (leggings, bodysuits, sports bras) to consumers. We deliver to the 27 member states of the European Union and to Canada. Orders cannot be shipped to any other destination.

Neovia may update these terms at any time; the version applicable to an order is the one accepted by the customer when the order is confirmed.

3. Products

Products are described and photographed as accurately as possible. Colours may nevertheless vary slightly depending on your screen settings. A size guide is available on every product page; please refer to it before ordering.

Offers are valid while they are displayed on the site and while stocks last. If a product becomes unavailable after you order, we will let you know as soon as possible and refund you in full.

4. Prices

Prices are shown in euros (€).

• European Union: prices are shown inclusive of VAT. Neovia is registered under the Import One-Stop Shop (IOSS): the VAT of your delivery country is included in the price you pay and no duties or additional fees are charged on delivery.
• Canada: prices are shown exclusive of tax. Orders are shipped as exports; customs duties, GST/HST and any brokerage fees are payable by the customer and may be collected by the carrier on delivery. These amounts are neither set nor collected by Neovia.

Shipping costs are displayed before you confirm your order (see section 7). Neovia may change its prices at any time; products are invoiced at the price in force when the order is confirmed.

5. Ordering

Orders are placed online in the following steps: add products to the cart, review the cart, enter your details and delivery address, choose a payment method, read and accept these Terms of Sale, then confirm by clicking “Place order”.

You can review the details of your order and correct any errors before confirming it. The sale is concluded when you receive Neovia’s order confirmation e-mail. Neovia reserves the right to refuse or cancel any abnormal order, any order placed in bad faith, or any order from a customer with whom a previous dispute exists.

6. Payment

Payment is due in full when the order is placed. It is made online through our secure payment provider Stripe, using the methods offered at checkout: payment cards (Visa, Mastercard, American Express), wallets and local payment methods available in your country.

Transactions are encrypted (SSL/TLS) and may require strong customer authentication (3-D Secure). Neovia never stores your card details. Orders are processed only once payment has been confirmed.

7. Shipping & delivery

Products are shipped from our partner warehouse located outside the European Union. A tracking number is e-mailed to you as soon as the parcel reaches the European Union or Canada and is handed to the local carrier. The delivery time stated below runs from order confirmation and includes transit up to that point.

Shipping costs

• European Union: €14.90 incl. VAT per order; free shipping on orders over €90.
• Canada: €12.42 per order; free shipping on orders over €75 (amounts exclusive of tax).

In accordance with Article L216-1 of the French Consumer Code, delivery takes place no later than 30 days after the order; failing that, the customer may cancel the contract after having unsuccessfully requested delivery within a reasonable additional period.

Please check the condition of the parcel on receipt and report any damage or missing item to Neovia as soon as possible, with photographs. The risk of loss or damage passes to you when you take physical possession of the products.

8. Right of withdrawal (EU)

Customers residing in the European Union have 14 days from receipt of their order to withdraw from the purchase without giving any reason. The conditions, exceptions and model withdrawal form are set out on our Right of Withdrawal page.

For customers residing in Canada, these terms apply without prejudice to the mandatory rules of the applicable provincial legislation, in particular the Quebec Consumer Protection Act.

9. Returns & exchanges — our 30-day promise

Beyond the statutory right of withdrawal, Neovia accepts the return of any item that is unworn, unwashed, with its tags attached and in its original packaging, within 30 days of delivery. This commercial commitment does not replace your statutory rights.

To start a return, contact support@neovia.com quoting your order number. Refunds are issued to the original payment method within 5 to 10 business days after we receive and inspect the items. Return shipping costs are borne by the customer, except where the product is non-compliant or Neovia made an error.

10. Statutory warranties

Independently of any commercial warranty, Neovia is bound by the following statutory warranties towards consumers:

• Legal warranty of conformity (Articles L217-3 et seq. of the French Consumer Code): you have two years from delivery to act. You may choose between repair and replacement, subject to the cost conditions provided by law, and you do not have to prove the defect during the first 24 months. This warranty is free of charge.
• Warranty against hidden defects (Articles 1641 et seq. of the French Civil Code): you may request cancellation of the sale or a price reduction within two years of discovering the defect.

To make a warranty claim, contact support@neovia.com with your order number and photographs of the defect.

11. Liability

Neovia cannot be held liable for non-performance of the contract in the event of force majeure, of an act of the customer, or of an unforeseeable and insurmountable act of a third party. Product photographs and descriptions are not contractual. Neovia is not liable for duties, taxes and customs fees charged on delivery outside the European Union.

12. Personal data

The data collected when you order is required to process and deliver your order. How we handle it — including transfers to our partner warehouse outside the EU and your rights — is described in our Privacy Policy.

13. Intellectual property

All elements of the site (brand, texts, photographs, visuals, logos, designs) are the exclusive property of Neovia or its partners. Any reproduction or use, in whole or in part, without prior written permission is prohibited.

14. Mediation and disputes

If you have a complaint, please contact our customer service first: support@neovia.com.

In accordance with Articles L611-1 et seq. of the French Consumer Code, if no amicable solution is found within one month, you may refer the matter free of charge to the consumer mediator appointed by Neovia: [TO BE COMPLETED: name, postal address and website of the appointed mediator].

15. Governing law

These Terms of Sale are governed by French law. For consumers residing in another state, they apply without prejudice to the more protective mandatory provisions of their national law. Any dispute not settled amicably falls within the jurisdiction of the competent courts under ordinary rules.
